Terms and Conditions for Sendate

Welcome to Sendate. By downloading, accessing, or using the Sendate application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Overview of the Service

Sendate is an open-source, peer-to-peer file transfer and clipboard synchronization application that operates entirely over your local network. It allows users to send and receive files directly between devices without the use of external servers or cloud storage.

2. License to Use the App

Sendate is open-source software distributed under the MIT License. You are granted a non-exclusive, personal, revocable, non-transferable license to download, install, and use the App on your devices in accordance with the terms of the MIT License and these Terms.

3. User Responsibilities

By using Sendate, you agree that you are solely responsible for your conduct and any data, text, files, information, or other content ("Content") that you transfer using the App.

You agree NOT to use the App to:

  • Transfer any files or Content that violates any local, state, national, or international law.
  • Transfer malicious software, viruses, worms, or any other code of a destructive nature.
  • Transfer copyrighted material without the permission of the copyright owner.
  • Engage in any activity that interferes with or disrupts the local network or devices of other users.

4. No Cloud Storage or Backups

Sendate operates locally. We do not store, backup, or have access to any files you transfer. If a file transfer fails, or if a file is lost or deleted from your device, Sendate cannot recover it. You are solely responsible for maintaining backups of your files.

5. Security and Privacy

Transfers occur directly between devices on your local network (Wi-Fi or Hotspot). While the transfer is peer-to-peer, you are responsible for ensuring that you are connected to a secure and trusted local network. Sendate is not liable for data intercepted on unsecured public networks.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Sendate, its developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to your device; or (c) any interception of files over a local network.

8. Third-Party Links and Open Source Components

Sendate relies on open-source libraries and frameworks. Your use of the App is also subject to the terms of these third-party open-source licenses.

9. Changes to the Terms

We reserve the right to modify or replace these Terms at any time. Any updates will be reflected in the App's repository. By continuing to use the App after those revisions become effective, you agree to be bound by the revised terms.
